Kelly Merritt pled not guilty Monday to driving under the influence and refusing to submit to a breath test, after he apparently rolled his semi-truck Saturday.

Merritt’s truck went off the shoulder of I-80 around 2:23 p.m., according to a Nebraska State Patrol report.

Kelly, 50, was first treated at Great Plains Health and then put in jail over the weekend. He was bruised, battered and wearing a neck brace Monday when he appeared in court.

He is from Caldwell, Ida.

At first, Merritt was prepared to waive his right to an attorney and plead no contest, but when Lincoln County Judge Kent Turnbull explained his rights, he noted that the blood-alcohol tests were not complete yet.

Merritt told the court he would hire an attorney.

His bond was reduced by half to $2,500 and he is scheduled to be back in court on Aug. 28.
