A Hershey man was injured and cited for refusing an alcohol test after he rolled an all-terrain-vehicle near Hershey in the middle of the night during the weekend.

Sheriff’s deputies received a report around 1:15 a.m. Sunday morning of an injury accident near Sand Road and U.S. Highway 30, a mile and a half west of Hershey.

When investigators arrived, they found an overturned red Honda ATV at the railroad right-of-way south of the intersection. The driver, 34-year-old Hershey resident Terry Barthel, was severely injured and could not leave on his own, according to a Lincoln County Sheriff’s report.

Barthel was westbound on railroad right-of-way when he lost control, rolled the ATV and was ejected, the sheriff said.

Barthel was taken to Great Plains Regional Medical Center for treatment. Deputies and emergency medical technicians believed Barthel was under the influence of alcohol at the time of the accident, but Barthel refused to submit to a chemical blood test.

Barthel was charged with refusal to submit to a chemical test.

The investigation is ongoing and additional charges may follow, the sheriff's statement said.
