County court: Charges bound to higher courtTell North Platte what you think
 

William Theus 27, of North Platte waived his preliminary hearing Thursday and charges of driving under the influence of drugs, felon in possession of a firearm and probation violation were bound over to district court.

Theus’ bond was reduced by half to $50,000.

Theus was arrested around 9:30 a.m. on Jan. 15, when police found his Explorer parked in the middle of the First National Bank parking lot. Witnesses said it ran over a curb and had difficulty parking.

Theus was driving. He was unsteady on his feet and his speech was slurred. A search turned up a glass pipe that contained white residue consistent with methamphetamine, as well as .22 caliber rifle.

IN other county court action Thursday:


Niles

Dakota Niles, 22, facing charges of failure to appear and driving under suspension, had his case continued until April 10 at the request of defense attorney Blain Gillett.

The long continuance is necessary so a charge against Niles for sexual assault can be resolved in district court first. That outcome may change the county charges, or they could be dismissed.

The failure to appear charge is in connection with the sexual assault case.

Niles faces five counts of sexual assault of a child. In September 2012 a 14-year-old girl said Niles assaulted her. Niles pled not guilty in Lincoln County District Court, paid bond and was released until his next hearing. He didn’t’ show for that hearing and was picked up by a Nebraska State Trooper.

Niles is scheduled to appear in district court on Feb. 24.


Gastineau

Roger M. Gastineau, 21, pled guilty to three counts of theft in a plea deal. Two counts of theft were dropped. He was sentenced to 10 days in jail.

Prosecutors said that Gastineau and two of his friends were out drinking on Oct. 19 and decided it would be fun to do some “car hopping” (street slang for breaking into cars and taking property).


Bristol

Donald R. Bristol, 26, of North Platte, waived a preliminary hearing and a charge of felon in possession of a firearm-second offense was bound over to district court.

Lincoln County Judge Kent Turnbull informed Bristol that because of the second offense, the charge had been amended from a class 1C felony to a class 1D felony with a mandatory minimum of three years and a maximum of 50 years in prison.

Bristol paid 10% of a $25,000 bond on Jan. 21.


In other court action:

• Todd O. King Sr., 43, waived his preliminary hearing on a charge of terroristic threats and was bound over to district court. Bond was lowered to $25,000.

• Dwayne K. Palmer, 35, waived a preliminary hearing and was bound over to district court on charges of possession of oxycodone and driving under the influence of alcohol. His bond was lowered to $3,500.

• Jasen L. Westlake, 31, of North Platte pled no contest to a charge of theft and was sentenced to 6 months probation. Westlake is charged with using a stolen credit check at Menards to purchase items worth $848. He has returned all the items to Menards.
