Sean McCarthy, 43, was sentenced to 2-3 years in the state pen Monday for forgery.

McCarthy was convicted in August, after he wrote a series of bad checks early in the year. He pled no contest to the charge, accepting a plea deal that dropped a second charge of forgery, one charge of theft by deception.

McCarthy wrote bad checks to Sun Mart, Gary’s Super Foods and Wal-Mart.

Deputy County Attorney Jennifer Wellan asked for penitentiary time, noting that McCarthy has a substantial criminal history.

Defense attorney Blaine Gillett asked the court to instead send McCarthy into a long-term treatment program for drug and alcohol abuse.

“I cannot minimize my client’s history, but, this is a crime of property not violence,” Gillett said. “He has paid over $3,000 in restitution.”

But Lincoln County District Judge Richard Birch declined to consider probation, saying it is not appropriate.

Much of McCarthy’s criminal history is from Sarpy, Douglas and Lancaster counties. He was sentenced to the state pen in September 2004 for up to nine years for theft, bad checks, child abuse, false imprisonment and third-degree assault, and released in December 2009.

He went to the pen again in October 2010 for up to four years for theft and forgery and was released in December.

Those charges came out of Douglas and Sarpy Counties.

McCarthy’s Lincoln County record shows arrests for domestic assault, false reporting and being a fugitive from Lancaster County.
