A Wyoming truck driver is in jail after he allegedly beat up a man who lit a cigarette in the bathroom of the Hershey truck stop Saturday.

Sheriff's deputies were called to the Hershey interchange at 12:50 p.m. Saturday, on a report of two men were fighting inside the Western Convenience Truck Stop. Witnesses said one man had serious injuries, according to a sheriff's statement.

The Hershey first responders and Sutherland Rescue were also summoned.

Deputies learned 46-year-old truck driver Martin Davidson of Cheyenne got into an argument with another man while in the restroom. The other man started smoking in the restroom and Davidson told him he should not do so.

Shortly after the argument started, Davidson hit the man and he went to the floor, where Davidson allegedly kicked and stomped him, causing serious injuries.

Davidson left and fled west on I-80 in his semi-truck. Deputies found him and stopped him at near Paxton.

Davidson was taken into custody and transported to the Lincoln County Sheriff’s Office where he admitted he was in a fight with the victim, the sheriff said.

The victim's jaw and several facial bones were broken, including his sinus cavity, the statement said. After the man was stabilized, he was flown by helicopter to Creighton Medical Center in Omaha for treatment.

The victim said Davidson stomped him several times in the face and upper body.

Davidson was wearing "very large work boots with deep lug soles," the sheriff said.

Davidson is charged with first-degree assault, a Class II felony, punishable by up to 50 years in prison. Bond is set at $100,000.
