Johnston was arrested Sept. 9 after a teenage mom came to authorities, looking for money to help raise her year–old baby.

Police Information Officer Rodney Brown said the Lincoln County Attorney’s Office asked for an investigation regarding a 15-year-old girl who allegedly had sexual intercourse with an adult.

Now 17, the girl requested help at the Lincoln County Child Support Office. An earlier paternity test had indicated that Johnston is the biological father. After a police investigator questioned Johnston he was arrested and jailed.

Nebraska state law requires minors to be at least 16 years-old to legally have consensual sex and in this case the girl was 15 and Johnston was 22 at the time the baby was conceived. There of statute of limitations in Nebraska on sexual assault of a minor.

Johnston's bond was lowered from $100,000 to $75,000.
