Jerred Melcher

Jerred Melcher, 30, will spend 1˝-3 years in the state penitentiary for his fourth offense driving under the influence of alcohol.

He received credit for 104 days in the county jail.

Defense attorney Blaine Gillett asked for leniency. He told the court that Melcher also underwent treatment at Cornhusker Place in Lincoln and actually went through a longer period of treatment than the average person.

Gillett said that Melcher’s level of maturity has markedly improved.

Gillett put Melcher on the stand and questioned him about his progress since treatment. Melcher testified that he has participated in after-care and is attending AA meetings 3-4 times a week.

Gillett asked the court to consider probation and Deputy Lincoln County Attorney Jennifer Wellan said she had no objection to probation.

But Lincoln County District Judge Donald Rowlands thought otherwise.

“Looking at your prior records this is actually your sixth DUI conviction and the court cannot consider probation this time,” Rowlands said. “The county courts have been very lenient with you in the past and given you a lot of chances.”

Rowlands also revoked Melcher’s drivers license for 15 years to begin upon his release from prison.

Melcher was taken to jail, wearing a tie.
