Donald Warfield, 70, of North Platte was sent to the penitentiary Monday for five years for sexual assault of a child.

District Judge Richard Birch said he would serve no less than the five years, except for credit for 343 days he has already served in county jail.

Warfield was arrested June 11 and convicted in district court on April 22.

Warfield lived in a trailer on the victim’s family’s property and inappropriately touched the underage female who is now 16, beginning when she was seven-years-old and continued to for 3-4 years, prosecutors said. There is no statute of limitations in Nebraska on child sexual assault.

Defense attorney Pat Hays asked the court to consider that Warfield is an elderly man with health problems who claims he doesn’t remember assaulting the child.

Deputy Lincoln County Attorney Jennifer Wellan submitted the decision to the court, saying the evidence speaks for itself.

Birch cited Warfield’s prior sex assault charges in sentencing, reminding Warfield of a conviction for assaulting a 14-year-old girl in 2002, and noting that Warfield failed to register as a sex offender in April 2012.

Warfield has been held on a $125,000 bond.
