A North Platte man will go without a driver’s license for a year, pay $1,000 fine, spend 30 days in jail, and be on probation for 18 months for his second-offense drinking and driving.

Brett Foster, 34, of North Platte, was sentenced Thursday after he pled guilty to second-offense driving under the influence of alcohol.

In addition, Foster will wear a SCRAM ankle bracelet that monitors alcohol intake during his probation, and he will be subject to random tests for drugs and alcohol.

Foster was originally charged with third offense DUI, but one of his prior offenses was outside the statute of limitations.

Deputy Lincoln County Attorney Austen Leighty told the court that Foster was uncooperative during his field sobriety test when he was stopped, and he had to be taken to the jail for a breath test.

Leighty asked for a stiff sentence.

Lincoln County Judge Kent Turnbull told Foster he would “go along with the county attorney’s request for a lengthy probation on this because I know you quite well and your prior record.”

A SCRAM monitor takes samples of perspiration every 30 minutes to monitor and report blood alcohol levels, according to the manufacturer.
