In Court: Green, Marquez, Russell, othersTell North Platte what you think

Stephen Marquez, 24, of North Platte pled not guilty Monday to burglary at ABC Auto Salvage on March 9, when a pickup load of items was taken from the salvage yard, according to a sheriff’s spokesman.

Marquez and Shawn Reese are thought to have worked from 3:30-6:30 a.m. inside the yard, using trucks belonging to the business to shuttle batteries, tires and metals to their truck parked outside the fence.

The two were arrested later that day.

Marquez is already in jail on another charge, serving 180 days for possession of codeine. He was sentenced on that charge March 25.


Shawn Reese, 23, also appeared for arraignment on charges in the burglary of ABC Auto Salvage.

Defense attorney Patrick Hays asked for a bond reduction but Deputy County Attorney Jennifer Wellan objected. Wellan cited Reese’s history of thefts and burglaries and said Reese has been convicted and sentenced to jail in the past, and noted that he also served a stint at the McCook Work Ethic Camp.

Rowlands lowered bond to $5,000, on the condition that if Reese pays the required 10% and gets out of jail, he must report daily to the sheriff’s office to be tested for alcohol and drugs.

Also in district court:


Christopher Russell, 19, of North Platte, pled not guilty to first-degree sexual assault of a child.

Russell was charged March 1 with first-degree sexual assault of a 14-year-old girl. The girl’s mother told police that Russell was sexually involved with her daughter. The girl said the relationship was consensual, but in Nebraska, it is illegal for anyone over age 19 to have sex with anyone under 16. Russell was already in jail on shoplifting charges when the investigation began, and Russell got out on bond before the investigation was finished, so he was arrested again to reclaim his bunk at the jail.

Defense attorney Martin Troshynski asked for and received more time to take statements from the victim and witnesses.


Joseph Miller, 42, of North Platte, was convicted of possession of cocaine and marijuana. Miller pled no contest to both charges. He will be back for sentencing on June 3.

Zachary Thompson, of North Platte pled not guilty to possession of marijuana and xanax and will be back in court in early May.

James Thornburg, 29, of North Platte, faced arraignment on charges of failure to register as a sex offender and failure to report every six months to the sheriff.

Defense attorney Blaine Gillette asked for time to gather more information and Thornburg’s case was continued until early June.

Stanley Churchwell, 27, of North Platte pled not guilty to theft.

Defense attorney Patrick Hays asked for a bond reduction, which was denied by District Judge Richard Birch. Deputy Lincoln County Attorney Jennifer Wellan said, “Every time Mr. Churchwell bonds out of jail he gets arrested again.”

Churchwell was jailed on Feb. 27, just 17 days after he got out of jail for previous theft. He was charged in the theft of three car axles from a house in the 800 block of East Sixth. Police said three men including Churchwell were trying to sell the axles, as well as a bumper and grill, for cash at North Platte Metals. The axles had an estimated value of $1,300 – an amount that made the charge a felony.

Julian Daily, 39, was arrested as an accomplice in the same thefts and pled not guilty Monday to aiding and abetting a felony as well as misdemeanor theft. Defense attorney Michael Nozicka asked for a bond reduction, which would have been the second one for Daily. Wellan objected to any more bond reduction and Birch agreed. Daily’s bond remains at $12,500.
