Koch was arrested in the early morning hours March 4 after police found him inside Gracie May’s restaurant on East Philip.

The burglar alarm was still sounding when police arrived, and the front glass door was broken. Koch was ordered out of the building and arrested without resistance. He was carrying meth and was thought to be under the influence at the time, Police Information Officer Rodney Brown said.

Lincoln County District Judge Donald Rowlands ordered a pre-sentence investigation and, under objection by Deputy Lincoln County Attorney Jennifer Wellan, lowered Koch’s bond from $25,000 to $5,000. He set sentencing for May 6.

If Koch bonds out of jail, he is required to report to the sheriff’s office daily until sentencing.

Joshua Foust, 23, of North Platte, pled no contest to an amended charge of attempted possession of a defaced firearm.

Judge Donald Rowlands ordered a pre-sentence investigation.

According to details read in court, Foust left his house on Jan. 1 carrying a shotgun. Friends called the police because they believed he intended to harm himself.

Police found the shotgun in his pickup.

Foust has a previous felony conviction for sexual assault and he was arrested for possessing the gun.

He was initially charged with being a felon in possession of a firearm, to which he pled not guilty.
