Dana Lyon of North Platte was sentenced to 1-3 years in the Nebraska State Penitentiary for his fifth offense of driving under the influence of alcohol and driving under suspended license. Lyon, 59, received credit for the 101 days he has spent in the county jail. His license had already been suspended for 15 years and he is in the midst of that term, but Lincoln County District Judge Richard Birch re-imposed the suspension to begin again. Lyon’s record actually shows eight convictions for driving under the influence, but some were long ago. Defense attorney Martin Troshynski asked the court for probation, noting that Lyon is a combat veteran of Vietnam and has had a drinking problem since returning home after the war. Deputy Lincoln County Attorney Jennifer Wellan objected. Wellan said that probation was previously tried and within three months Lyon started drinking again. Birch agreed that probation would probably serve no purpose.
