Boe was sentenced Monday to 3-9 years in the state pen for attempted sexual assault of a child.

The 12-year-old girl told investigators in July that she had sex with Boe, during an interview at Bridge of Hope shelter in North Platte. Bow was arrested Sept. 18 and has been in jail since. On Dec. 3, he pled guilty to an amended charge of attempted sexual assault of a minor.

Lincoln County District Judge Donald Rowlands handed down the stern sentence after hearing arguments from both the prosecution and defense.

County Attorney Rebecca Harling asked the court for penitentiary time, with reservations. She said she has known Boe for a long time and feels he would benefit from treatment. She said she would leave it up to the court whether treatment could be given locally or through the corrections system.

Defense attorney Ryan Wilcox noted that Boe has a minimal record, with only two minor in possession convictions. Wilcox also said the pre-sentence investigation showed that Boe is a low risk to re-offend and could be a candidate for probation.

Rowlands took all that into consideration but said Boe “must realize this is a serious sex crime and as a 19-year-old at the time he took advantage of a 12-year-old.”

“For those reasons I must sentence you to the department of corrections and you must register as a sex offender,” Rowlands told him.

Boe was given credit for 132 days in the county jail.
