Justin Belsky, 21, charged with organizing a massive BB gun shooting spree in August, will face justice in district court.

Belsky is thought to have been the leader of the shooting spree on Aug. 6, when windows on more than 200 vehicles and buildings were shot and broken with BB guns. Several windows of a car were also bashed with a blunt object and both rear tires were slashed in the early morning hours.

Police eventually found Belsky driving a suspicious van with three juvenile passengers, one of them a girl. Officers spoke with Belsky and passengers, who said they had been driving around shooting windows, according to prosecutors.

Two of the three juveniles in the van -- a girl and a boy who were younger than age 15 -- were not directly involved in the shootings, police said. They were cited for curfew violations and released.

Damage reports rolled into the police department for several days. On Aug. 21, after hundreds of calls, Belsky was charged with 199 counts of misdemeanor criminal mischief, plus aiding and abetting criminal mischief and felony criminal mischief.

By now, the charges against Belsky have been lowered and combined. As of Friday, he faces three counts of felony criminal mischief plus one count of contributing to the delinquency of a minor.

(Casey Mitchell, 17, was at one time cited for 199 counts of misdemeanor criminal mischief and two counts of felony criminal mischief. Mitchell charges were later amended to 10 counts of criminal mischief. He is in jail on a bond revocation.)


Proceedings

In court Friday, nine North Platte police officers were available to take the witness stand during a preliminary hearing. Deputy Lincoln County Attorney Jennifer Wellan called on four of them.

Investigator Roger Freeze and officers Jay Meduna, Kendall Allison and Rodney Brown all testified that that each investigated some of the reports of damage. From that information, as well as interviews with Belsky and his passengers, police believe that Belsky’s group drove all over town while Belsky and the 17-year-old had took shots at vehicles and buildings with rifle style BB guns.

Police said they found two rifle-style BB guns, plus a pistol-style BB gun, in the van.

One of the juveniles told officers that the BB gun used for the shootings had been reloaded with more than 300 rounds during the spree.

Investigator Freeze said the juveniles told him that Belsky called them and told them he wanted the car at the Platte River Mall “messed up, because the owner was messing around with his girlfriend.”

Police said two of the minors in the van and an as-yet-unknown Hispanic man evidently bashed that car. That car-bashing evidently was the start of the window-breaking spree. The shooting spree began near the Key Estates Trailer Park on the east edge of town and continued west, before they turned north along Willow St. and into the area between Sixth and 17th streets.

Defense attorney Stephen Potter tried to pokes holes in the prosecution’s case. Potter said the values of estimated damages are inaccurate, because they do not differentiate between new and used repair parts or windows.

Potter also said noted Belsky is only charged with aiding and abetting, not with the shootings.

But Wellan countered that anyone charged with aiding and abetting can be considered a principle perpetrator in a crime if the facts indicate, so the charges against Belsky could intensify.

Lincoln County Judge Kent Turnbull ruled that there was sufficient evidence to bind the case over to district court.

According to Wellan, damage reports are still trickling in. The total is above $62,000.

Our system is not for justice, it is a "justice system". If the system were in existence to make sure everyone would recieve justice, Belsky would be in the state pen, the minors in juvenile pen, all guilty of a $62,000 felony & every victim, including the insurance companies would be paid 100% restitution by all of the perpetraters. Our "justice system" will find them guilty, some will spend thirty days in local jail/time served & they will be in the "probation system" for a year. They will violate probation repeatedly with no further consquences & they will perform 40 hours of public service, picking up trash in the park, on a sunny day, with tax payors providing suncreen. None of the victims will recieve a dime & ALL of the lawyers & judge will shake hands, have a few drinks and proudly exclaim that our "justice system" works very well indeed. That group recieves their full pay from WE, the tax payors. I wonder if any of the lawyers cars were damaged? Rally sad that 9 police had to waste time in court being available to participate in this justice charade, at tax payors expense, instead of being on the street chatching more punks.

i USED to consider Belsky a friend...well, a friend if a friend, but I will tell you all this. He had his friends come to me and say that he wanted to meet me and apologize. It never happened. I figured it wouldnt. I havent seen a penny, probably never will. I hope the legal system sends him to the Pen, even for a year, so he can get a new 'girlfriend' or become someones 'girlfriend.'

The real crime here is our local justice system, the CA, and judges , along with the local attorneys , have made this into a day to day gig. They know each other, they work every day just like we all do. The system is not about law, prosecuting it or defending it, just about going through the same old steps they did the day before and the day before that. They are all lazy , the CA does not want to have hundreds of witnesses to interview, the defense does not want to weed through the same, the cost of subpoenas alone. This is a case of not wanting to throw tax payers money after "tax payer victims" money. The kid will never repay it . So money and laziness is the real culprit and justice is the real victim. The plea away justice of North Platte will never change.

This is my final post on this... Lincoln County Judges & County Attorney's... remember you were voted in to protect the citizens of your County. We can vote you out with the same swipe of the pen with which you were voted in. $62,000.00 & climbing...

J-Man, just curious how a van can be suspicious... LOL. So, if Belsky allegedly wasn't doing the shooting, who was driving the van? Granted, there was a 17 -year-old involved, but there were 2 minors under 15. Is Belsky that talented that he can drive & shoot at the same time? Get that boy into Special Ops... I just need to let this go for tonight... Grrr'ing all the way. :o)

Public outcry, Rowdy1. Any attorney worth his salt will drag out a case for as long as they can, knowing bigger & better things are on the horizon, as far as crimes & the people involved. The more distant the memory of their client's crimes, the better. I still sit on glass every time I get in my car & my window will never be quite the same. Not such a distant memory for me...

The thing that amazes me is that they were both charged with 199 count of misdedmeanor criminal actions. But the charges were knocked down to two counts of criminal mischief , and the other charges consolidated into one. WTF? Why did they police even waste the time to arrest them?

Furthermore, whether the glass was new, used or the victims went to the desert to gather up the sand to produce their own glass, this schmuck should pay the airfare & for every drop of sweat produced to fix the damage he & his friends did.

Onlooker, not sure this is the appropriate place for your anger at the gun law issue. What IS at stake here is the multitude of damages done during this spree. I was one of them. I received a letter from the Victim's blah, blah, blah stating that this individual had been charged with 2 counts. Are you kidding me? While I agree Potter is only doing his "job" as an attorney, comparing the price of new versus used parts is inconsequential. The fact remains that this schmuck & his itty bitty friends decided to launch an attack on innocent, unsuspecting people, some of whom still can't afford to fix the damage, as is evidenced by the number of taped up windows. Here's an idea...why don't we slap this schmuck on the hand & turn him loose to do this again. Heck, maybe he'll take it a step further & break into our homes & destroy more than our car windows. Grrr... This pisses me off!!

This gun had a magazine capacity of 300? I'm confused. Didn't know Red Ryder had that capacity. Did it have a pistol grip and a collapsible stock? Was it manual cock or an automatic CO2 assault type weapon? Were the bbs full copper jacket or hollow point? So many unanswered questions. Maybe Diane Feinstein can add this weapon of mass destruction to her list.
