Carrizales was sentenced to serve 90 days for one assault and 120 days for another. Birch also fined him $500 and suspended his driver’s license because he was caught driving under the influence.

Carrizales has already served 144 days since the assaults, leaving him 66 days yet to serve, not counting "goodtime" provisions -- reduction of jailtime for good behavior.

Carrizales was arrested on May 19, when Lincoln County sheriff’s deputies went to Hershey Beach at the Sutherland Reservoir to check on a reported disturbance. After Investigation, prosecutors said that Carrizales and Juan Martinez, 19, of North Platte assaulted a young man and woman at a campsite.

Martinez was also charged with raping the woman and making terroristic threats in addition to illegal possession of a pharmacy drug, Alprozam.

By the time deputies arrived, Carrizales and Martinez had left, but with the help of witnesses’ descriptions and directions, the two were pulled over later on South River Road.

In court Monday, defense attorney Kent Florom said reports of the events that night were exaggerated. According to a sheriff's statement, Carrizales and Martinez hit the woman and man, who stepped in to protect here, near a campfire on Hershey Beach, after Martinez said the girl would spend the night with him.

But contrary to the sheriff’s statement issued the next day, Florom said the man said under oath in a deposition that he was never hit on the head with a burning log from the fire.

Also, Florom said family and friends of both the victim and Carrizales were camped nearby, but knew nothing of an assault.

Florom said the victim’s grandparents were camped just over 30 feet away and said they did not know an assault occurred.

Carrizales was released from jail on Oct. 9. He returned Nov. 27 to begin serving the rest of his sentence.

Martinez’ case is still pending in district court.

Like Watcher stated, all the male victim said was that he could be sure who it was who hit him. However, had other witnesses been actually investigated by the Lincoln County Police I'm sure it would become apparent who it really was that had hit him with the log.

To be accurate, the victim never said he "was not hit on the head with a burning log", he said he "couldn't say what happened" because he was hit from behind. Lesson learned - if you want to beat teens and get away with it, sucker punch them from behind so they can't testify against you.
