One of four men charged with raping women at parties in May says his $1 million bond is unfair.

Anthony Apodaca's attorney asked the court Thursday to lower his bond, shortly after a newly-arrested co-defendent, Anthony Nunnenkamp, appeared.

Nunnenkamp, 28, of North Platte, as scheduled for arraignment, but his case was continued until a later date. Defense attorney Ryan Wilcox told the court that he was assigned yesterday and needs more time to study the case.

Nunnenkamp was arrested Monday in connection with the alleged rapes, six months after the crimes were reported. Nunnenkamp’s DNA was found on swabs taken from one of the victims, police said.

Nunnenkamp’s bond is set at $100,000.

All four of the Apodacas, who were first charged in May, remain in jail on individual bonds of $1 million, and their court hearings were again continued. Wellan said prosecutors are still awaiting the results of more lab tests.

Defense attorney Patrick Heng argued that Anthony Apodaca’s $1 million bond was unfair, compared to the $100,000 bond for Nunnenkamp.

Heng said that Nunnenkamp has a longer record of prior crimes, many of which are violence related.

He said his client is “no angel by any stretch,” but his prior crimes are not violent in nature. And, he noted that Anthony Apodaca is only charged with aiding and abetting, not committing, the assaults.

Heng said, “Mr. Nunnenkamp has run a reign of terror all across the state, with a record of violence across several counties.”

Heng asked that Apodaca’s bond be reduced to $50,000.

Deputy Lincoln County Attorney Jennifer Wellan objected to any bond reduction.

Lincoln County Judge Michael Piccolo denied Heng’s request. He said he did not preside in the court when the bond was set for Nunnenkamp, and he added that he could not adjust Apodaca’s bond because that case has not progressed.

“I can’t consider any change in bond until at least a preliminary hearing has been held,” Piccolo said.
