Eric W. Devaney, 25, of North Platte was convicted Thursday of domestic assault and sentenced to more than nine months in jail.

Devaney was arrested Sept. 1 for domestic assault. He paid the required $1,500 and was released on bail the next day.

Deputy Lincoln County Attorney Jennifer Wellan told the court that Devaney’s record of assaults dates back to 2003 and Piccolo said he had to consider the pattern of bad behavior.

During the hearing, defense attorney Pat Hayes asked for a short recess so he could read the pre-sentence investigation report, which he had not seen yet. When the hearing resumed, Hays did not protest the findings.

Lincoln County Judge Michael Piccolo sentenced Devaney to 280 days in jail with credit for two days already served. Devaney seemed shocked and angry.


Casey's robbery

Charges against Daniel Shinkle, a 16-year-old accused of robbing a Casey’s store on Rodeo Road and Buffalo, were moved to juvenile court.

Shinkle has been in the Lincoln County Jail since Sept. 28, held on a $100,000 bond.

Defense attorney Kent Florom said Thursday he is trying to find a more appropriate juvenile facility for him.

Using a BB gun rifle, Shinkle allegedly robbed one of the registers at the Casey’s store, said Sgt. Gary Hovey of the North Platte Police.

Hovey said police were called to the store shortly after midnight and told that a young man wearing a black ski mask robbed the store and left on foot. The investigation led police to a home on West Ninth, where they found the teenage boy with the 19-year-old woman, Amanda Giles, Hovey said.

Hovey said police found a BB gun, money and clothing that matched the description of the crime at the house.

Shinkle reportedly was a runaaway from his home in California and a brother of Giles’ domestic partner. Giles was charged with accessory to a felony because she allegedly tried to hide money and conceal the Shinkle from law enforcement.

Deputy Lincoln County Attorney Austin Leighty said Thursday that Shinkle’s charges will be amended for juvenile court and some of them will likely be dropped.


In other court action:


• Dylan DiGiovanni, 20, of North Platte was scheduled for hearings on five separate charges, cincluding three charges of theft, one of failure to appear and one for possession of drug paraphernalia. At the request of defense attorney Pat Hays, all the charges will be bundled together. DiGiovanni is scheduled to return to court Nov. 8.


• James Hearn, 47, of Fargo, N.D. waived his preliminary hearing for theft by taking and his case was bound over to district court. Defense attorney Kent Florom asked for a bond reduction and Lincoln County Judge Kent Turnbull reduced it by half, to $12,500.


• Bryan Werkmeister, 40, of North Platte waived his preliminary hearing on a charge of possession of amphetamine. His bond was reduced to $5,000 and his case was bound over to district court.

This guy (Eric) is a weird dude... Back when I was working at a gas station he would stand in there for hours doing nothing but staring at us girls... We had to have male customers kick him out of our store sometimes because he just got to weird... I personally don't know this guy. Nor do I want to know this guy. But he freaks me out!!!

Eric should have gotten more time. To bad we couldnt have gotten him a few years ago when he thought he was tough and walked up and punched some guy. had a good discription that it was him but it wasn't a solid yes on him.
