No-one has proven he did anything with this girl! Dates are not correct that she has given, and there is reasonable doubt that she is not being honest! So of course with this information, I will believe Koty! The history of honesty from the girl appears to be "tainted", and doesn't seem to have improved over time. I feel very sad for her, that the difference between love and sex have been tainted by whatever has happened in her life, and hope that one day she will learn that difference. I apologize for the anger outburst earlier. When you know something others don't, it is extremely hard to not be frustrated by posts! |

The legal age of consent in Nebraska is 17, this girl, NO matter how provocative she dresses or if she is where she shouldn't be. SHE IS NOT old enough to consent. Good for her for having the nerve to come forward. I was having sex with older men at 14 probably because I was molested as a child. Maybe this little girl can get some counseling and learn to respect herself enough to say no. By the way two of the older men that I slept with at 14 have been in this very paper for still having sex and molesting CHILDREN between the ages of 12 and 16 and these men are now in their 50s. |

You are right Big Red Fan. She is just a child and he knew better. Its very shocking when women come in here defending this sort of thing. I suspect they have been raped/sexually assaulted too and have never really dealt with it or healed their wounds from it. They are insensitive to victims like this 14 year old because they are just as insensitive to themselves. You or I can't make them take an honest look. We can continue to look out for victims and be a strong voice for them. |

Whats wrong with the 14 yr old? My guess is that she got PO'd at the guy and all of a sudden he is blasted with "sexual assult". I'm SURE if he was "well aware" of HER AGE..then SHE was "well aware of HIS AGE" also. I'm not condoning the actions..but I have to also ask..WHY DID IT TAKE FIVE TIMES of sexual contact with him?? Girls like this should also get more than a slap on the wrist. I believe that Dakota is innocent and she's just turned him in to get herself out of trouble because she got caught doing something illegal!! you don't see charges being brought against her for a B&E do ya?? Nope...sure don't. I'm not a pedo and I don't take kindly to being called one. I was 14 once doing the same crap this lil girl is doing. And guess what I sent someone to prison too...for actual rape, but still got others in trouble when I reported the actual rape. Luckily I kept my mouth shut and never gave names but the evil man who did rape me is still behind bars. Judge all you want and say what you want but you'll never understand unless you know both sides to every story. |

I don't know either of the participants in this event, however it seems to be more and more prelevant where you hear this kind of story. Its a fact that girls mature faster than boys and sometimes a 14 year old girl is more mature than a 19 year old boy. Rape makes it sound like a girl was attacked in a back alley in the dark and brutally assaulted. In cases like these I think there needs to be a charge of "Sex with a minor" or something like that which doesn't indicate an assault or it being forcible. If they had sex 5 times, serious doubts arise that it was a "rape". I am not saying it's ok for anyone to have sex with a young girl, but I also don't believe there is cause to ruin a young man's life for being a boy. And at 19, that's really what he is, a boy. (I just realized he is 21) which changes it somewhat, however the context of my message still stands for some of the other stories I've read. And for the mothers and fathers of 14 year old girls. You might look twice at them before they go to school, go bowling, go to the mall. The revealing clothing they wear is not what most of society deems acceptable for a 14 year old. Make up so heavy you can't tell what they really look like, tops so low they are show more clevage than most 34 year old women show. Its a 2way street in a lot of cases. Again, don't know these two and moreso this is just a general post. |

and this is old talk back from a year ago explains the reason I mentioned that his older brother got arrested: (it's about his older brother) "I wish the reporter for the Bulletin would get all the facts correct. Mr. Niles was convicted of a Class II felony, not 1st degree, the young girl was going on 15, not 13 when she got pregnant, and Mr. Niles was 19. As for a having a "long history of associating with underage girls and plying them with alcohol”, his attorney objected to that and clearly stated there was nothing to support the claim. Until meeting this young woman, most of his girlfriends were his age or older. I also know them both and competely agree with Scooter. The young lady in questions plays a major role in her child's life and is doing a wonderful job! Mr. Niles has had as much contact as possible and is very open about having a child and wanting to straighten himself out so he can have an active role in it's life. The young mother was very brave in her statements to the authorities. She could very well have blamed Mr. Niles for everything, but she didn't...she chose the truth. He, in turn, refused to let anyone lay any blame on her! The whole situation is an extremely sad one, and casting blame only causes more pain. Haven't they both been through enough? One thing for sure is, this small child is not to blame for the circumstances of his birth and should have the chance to know BOTH of his parents. I also wish them the best and offer my support...100%."

Are you people kidding me???? There is a reason 18 is the cut off line between an adult and a CHILD!!!!!!! Kids do these things. ADULTS ARE EXPECTED TO KNOW BETTER!!!!! RAPE is the key word here. Maybe he should have checked her driver's license that she does not have because she is ONLY 14!!!! Hey, Did anyone else notice that Clemente Carrizales got off on misdemeanor charges after assisting in an "alleged" brutal rape followed by an attack on 13 yr old, which set him on FIRE? Oh no sorry you are all to busy debating how horrible this guys family is/was. An whether or not consentual sex with a 14 year old girl is rape. (Which by the way IT IS NOT!)Odd. |

She has already been discredited on at least 3 of the 5 so called "assaults" because he had an alibi...Something smells fishy there don't it?! I wouldn't be surprised in a few weeks she'll be arrested for false reporting and be sent away. She went around school again today bragging how she put him and jail and her so called friends turned on her. They know if it did happen it wasn't by any means rape. DeeBee is right. There was a new term out in a dept. I worked in out of state. It's called "Peer Rape". An older person of consenting age knows that to a minor boy or girl that they may be a peer, a person that they think has it all together. They see them with there other friends, partying, playing, spending time together doing whatever. The minute these perverts, which they are for wanting sex with a CHILD, see an opening, maybe a loss of the victims close family member or friend, or just trouble at home or school, they attack! Give as much attention as they can so the child will trust them completely. When it doesn't happen in this fassion then it's the time to try the Party Plan. |

On a side note, He was not living in NP last spring. He was living out of town, and working out of town.And on the Saturday in question, was with his long-time girlfriend, and extended family the ENTIRE night. I find it completely sickening that anyone can be arrested without law enforcement "Investigating" (which in case someone is confused) is their job! also facebook offered some very nice pics and video's of a 14 year old being a "child" as you have put it. Amazing the truths you find when you open your "rose colored glasses" and look. |

So why are people even mentioning names of the mother and brother? Get a life. I myself come from a family of people who have done wrong...And yes I myself used to live in that kind of lifestyle also, but I am now a full time business woman and a hard working mother whos kids are greatly involved in school and sports activites...Just because people come from a "bad" family does not give anyone the right to judge them or slander their name. In my opinion, I am living a better and healthier lifestyle than most of my peers. And I came from a broken home with parents that are felons and have drug charges. But on a different note, in my opinion...At age 14, when you are out drinking and hanging out with older guys and making the decision to have sex...Why should the older guy be the only one held responsible. When I was 14 I was more than capable of making my own decisions and capable of telling someone no. But if she had intercourse with him on numerous occasions, shouldnt that say something about her behavior also? I am not saying what he did was ok, because him being the older more mature one, he should not have crossed those boundaries. But when you have teenagers out drinking and hanging out with older guys, there is a fine line on both ends that should not be crossed but is on a lot of occasions. |

As I understand this 14 year old isn't as innocent as she claims to be. Additional charges may be filed...yes against a bunch of other older boys/gentlemen as well. Her running around school telling everyone how fun it is and bragging about who she's slept with at 14. HORRIBLE! The mother should be ashamed! She's probably going to loose all of her kids being this 14 year old was sneaking out on 2 of the accounts. I'm not blaming it all on the girl. Yes, Dakota should have known better but I do happen to know alcohol was involved on every occasion. And what does his family who doesn't even live in North Platte anymore have to do with this??? NOTHING! He has been on his own for 3 years so brf get your "Facts" straight. |

What happened to "innocent until proven guilty"? His brother is serving time...that much is true. His mother has almost 8 yrs clean and sober and paid her debt to society. How does her past conviction enter into this? Yes, he has younger siblings, who are excellent students and very likable, respectful young people who know the mistakes made by Joe and their mother and respect and love them both for the lives they live now. Joe has a beautiful child and, in my belief, no child is a mistake. Maybe, BRF, you and 1coolmom need to look at the mistakes made in your own lives before pointing any fingers. I do happen to know Dakota, 'tho haven't seen him for quite some time. I don't believe he's following in his Brother's footsteps. He has always been more responsible than Joe ever thought of being. This girl said they had sexual intercourse 5 times. If it were rape, why did it take 5 times to bring it to the attention of authorities? Again, not condoning the actions, but wondering why it took so long to decide she had been violated? Kody's immediate family has been & will most likely always be a train wreck.
