Tracy Neal Black, 52, of Evanston Wyo., pleaded not guilty Monday to attempted robbery of the Farmer’s State Bank in Wallace. Black appeared in Lincoln County District Court for arraignment on the reduced charge of attempted robbery. He was originally charged with robbery.
Black is one of two men arrested Aug. 13 after one of them – Drew Alexander Steier – entered the Farmer's State Bank with a handgun while Black waited in the vehicle outside.
The robbery was unsuccessful. The bank tellers told Steier they couldn’t get to the money because it was locked up, bank president Bob Mayber said at the time.
Steier left the bank empty handed. He and Black drove out of town but were picked up about an hour later about 50 miles west of Wallace by law officers. They were traveling on Nebraska Hwy. 61, about a mile north of Imperial.
Lincoln County Attorney Rebecca Harling told the court Monday that after reviewing all the investigative reports, the reduced charge was warranted.
Defense attorney Robert Lindemeier advised Black to plead not guilty to the amended charge. Lindemeier asked Judge Donald Rowlands for time to take more depositions.
Lindemeier also asked for a bond reduction, noting that Black didn’t actually go into the bank, he just waited outside in the vehicle. Rowlands lowered the bond from $250,000 to $125,000 and set a new hearing date of Oct. 29.
