Deanna Rae Fischer appeared in Lincoln County Court Thursday for a contested hearing on charges of sexual assault of a child. Fischer is accused of inappropriately grabbing and fondling a boy six years ago. The boy was 11-years-old at the time and has since moved to a foster home in Lincoln. Lincoln County Sheriff’s investigator Chuck Nichols took the stand and told the court he went to Lincoln to interview the alleged victim, who is now 17. The young man said Fischer once grabbed and squeezed his groin while wrestling around. He also told Nichols that Fischer would, at times, sit next to him on the couch and stroke his hair and his neck. Nichols testified that there was evidence that Fischer walked around the house in a robe that was open at the front, exposing herself to the children in the home, and once, one of the children walked into the kid’s bedroom and found Fischer on the bed naked, with the victim next to her, and three girls in the room too. Defense attorney Michael Nozicka said the fondling was unintentional and just happened from the wrestling. But Nichols said that the fact that it was a grab and a squeeze made it an unlikely accident. Nichols testified that the young man had chances to embellish his story but didn’t. Nichols said Fischer lied to him in the past and he felt the victim’s credibility was better than Fischer’s. Nozicka also said that the boy had been accused of stealing Fischer’s underwear while in her home. Lincoln County Judge Michael Piccolo found probable cause to bind the case over to district court. A district court date has not been set. Fischer, 39, was first charged in April 2011 for other alleged crimes that occurred more than six years ago. She was arrested again in June after Nichols interviewed the young man in Lincoln. Investigators once said Fischer was complicit in and took photographs of sexual assaults of children perpetrated by her husband Daniel in their home. Daniel, who helped with youth ministry at a church, took his own life after he was charged.
