Joseph Burke of North Platte might have thought he was at a medical clinic instead of a courtroom Monday. Burke complained of chest pains in Lincoln County District Court, but the court declined to give him medical advice. Burke is known for such complaints. He also complained about pain a month ago when he was arrested. Burke, 50, was found intoxicated in his car on June 16, parked near a Wendy’s restaurant, after a caller alerted police. Burke threatened police. He also complained of pain, so he was taken to the hospital, where he made more threats against the medical staff as well as the police and their families. The threats seemed serious enough that Burke was charged with four counts of terroristic threats. Each charge carries a maximum of five years imprisonment and $10,000 fine. He was also cited for DUI and no proof of insurance. In court Monday, Court defense attorney Martin Troshynski asked for more time to take depositions and prepare Burke’s defense. Lincoln County District Court Judge Donald Rowlands granted the request. Again, Burke complained of chest pains. As he was questioned, it became clear that he didn’t mean right then and there in the courtroom, but that he had them frequently as his case has progressed. Rowlands told him that the court couldn’t make medical recommendations and he would have to find medical care on his own. His case was continued until Aug. 13. Burke paid the required 10 percent of $25,000 bond on June 18 and is out of jail.
In other district court action Monday:
Harvey Steven Harvey, 49 was sentenced to 360 days in jail Monday. Harvey has a long history of protection order violations as well as assaults and probation violations, dating back to when he was a juvenile, prosecutor Rebecca Harling said. Harling asked Lincoln County District Judge Richard Birch for a prison sentence. Harvey’s attorney Stephen Potter argued for county jail time instead. Potter told the court that the female involved was cited for aiding and abetting the protection order violation and that there were numerous text messages sent by her to Harvey.
Caudillo Charged with two counts of manufacturing methamphetamine Nicholle Caudillo, also known as Nicholle Taulborg, pled not guilty. Her preliminary hearing was set for July 30. Defense attorney Robert Lindemeier told the court Nicholle had been in jail since May 29 and asked for a bond reduction from $25,000 to $10,000. Lincoln County Attorney Rebecca Harling had no objection and District Judge Donald Rowlands granted the reduction with conditions of no alcohol, random testing and searches. Caudillo also must report to the sheriff’s office five times a week.
