Two of the so-called “kid kennelers,” Lacy Jay Beyer and Bryson Lee Eyten, appeared in Lincoln County Court Thursday and pled no contest to sharply reduced charges of misdemeanor child abuse and false imprisonment.

Both Beyer and Eyten were sentenced to one year probation, and Lincoln County Judge Michael Piccolo said they must attend counseling if their probation officer deems it necessary.

The court is awaiting a report from the probation officer. Eyten is also attending parenting classes, defense attorney Mike Nozicka told Piccolo.

In what became a national story, police found two young children locked in a dog kennel Oct 25 in the home of Beyer, Ashly Clark, Bryson and Samantha Eyton. Police said the home and yard were littered with trash, dirty clothes, food, animal feces and urine.

All four were charged with felony child abuse and false imprisonment.

As the case progressed, key evidence was tossed out because the accused were not advised of their Miranda Rights when they were arrested, so statements they made during later interviews – in particular an interview the next day with Health and Human Service workers – was inadmissible.

The two were convicted of Class 1 misdemeanors, which each charge carrying a maximum penalty of a year in jail and $1,000 fine and a minimum of no penalty.

All four of the “kid kenneler” defendants are scheduled to appear Monday in Lincoln County District Court, although a clerk said that schedule is subject to updates.

Prosecutors did not respond Thursday afternoon to the Bulletin's requests for comments.

In stepping into such a filthy, unsanitary,place and KNOWING what they were called there FOR...I would o READ the MIRANDA to the jerks just to be on the SAFE SIDE!! And since WHEN does the HHS have to read the Miranda to anyone?? Better start requesting R & D to start reading the Miranda to their victims that they get in there too ( not that the little kids would inderstand it) that get questioned when they come taken there. Its a shame that such LOW punishment gets handed don to them. they should spend a year in the pen THEN a years probation

well there ya go Harvest...like I said had the police read these ppl their rights they would not have gotten off so easily. But, since the police didn't a lot of valuable evidence got thrown out and now here we are...with child abusers getting wrist slaps of misdemeanors and probation. it makes me ill.

Q. At what point are police required to inform a suspect of their Miranda rights? A. After a person has officially been taken into custody (detained by police), but before any interrogation takes place, police must inform them of their right to remain silent and to have an attorney present during questioning. A person is considered to be "in custody" anytime they are placed in an environment in which they do not believe they are free to leave. Example: Police can question witnesses at crime scenes without reading them their Miranda rights, and should a witness implicate themselves in the crime during that questioning, their statements could be used against them later in court. Q. Can police question a person without reading them their Miranda rights? A. Yes. The Miranda warnings must be read only before questioning a person who has been taken into custody. Q. Can police arrest or detain a person without reading them their Miranda rights? A. Yes, but until the person has been informed of his or her Miranda rights, any statements made by them during interrogation may be ruled inadmissible in court.

Harvestseeker, You obviously don't know law enforcement! JDAWG is right! The officer is responsible for giving Miranda rights at any time he is conducting an investigation and is about to attempt to question a suspect. PERIOD

i think in todays world there are people know the system and play with it to thier advantage . yes thing should have been done way different but. when a person knows how to run the system the system comforms to them . yes i think these parents shouldnt get kids back but i bet these kids are only used as meal tickets not children that are loved and cared for and when you put a money value on all you get is greed . if you know what i meen 1 kid equals this what does four kids equal . kids should be nurtured not tortured

Thanks to this screw up these get off really easy!!!! its pathetic!

it is my opinion that our justice system seems to break down at the courthouse.free lawyers,give up some names of someone else doing some crime and you win a golden ticket "PLEA BARGIN".now in this case someone just dropped the ball.REALLY SAD.hope the innocent children will be watched closely when they are returned to these so called parents (if they are not back with them yet).like a check on them everyday by HHS.

I am tired of all you people that don’t know and understand the system ragging on Law Enforcement in North Platte. Read the article, none of the information gathered by police was thrown out. The police did exactly what they were supposed to and the evidence they collected was not in question. The issue is the information gathered by HHS workers and the judge saying that the suspects should have been read their rights before HHS questioned them. HHS has not had to read Miranda in the past and this may change their policy, but the cops that handled this case did their job and did it well and took the kids out of the home. The system after the arrest is what has failed and the police have no control over that. The belief that every time police make an arrest they must read Miranda is false and if you don’t understand Miranda you should read up on it and educate yourself.

i am not going to mock the justice system, but i will mock the police for this. didnt we hear it with a few other cases here? the police force, bless them, just seem to need a refresher course in the first thing you say when you are cuffing an accused. Miranda should be the first thing said.

harvest we are not anywhere else in the world. get over your need to defend law enforcement. had rights been read these freaks would be convicted of harsher charges. its sickening how child abusers and molesters get away with their crimes.

O, bless our justice system. So, he keeps his job at a fast food restaurant. Gets to drive around in his car paid by the state. Then he gets custody of his children to continue to live in filth and dismay. Wonderful, wonderful wonderful. The only thing is he didnt beat them upside the head and make them mentally disabled. I am so proud of North Plate I could puke. How come there isnt anything said about living conditions or what they are required to do and who is going to pay the funeral cost of these children??? Once an offender always an offender and next time it wont be the kids in a kennel they will probably be abused or beaten to death. Just makes my heart pitter patter with joy over our police doing their job one more time.

If they had been arrested properly, the key evidence would not have thrown out harvestseeker. Where is all the people that said the guy was a good guy and had nothing to do with it. Innocent people dont plea down they fight to prove they are not guilty.

The Police did their job and arrested them that night. If you understood our justice system, JDAWG, you would not blame them. The police arrest, the county attorney prosecutes, and the Judges set the penalty. Those arrested get a free lawyer, if they cannot afford a their own, which is also paid by the taxpayers. If you want stricter sentences, you have to ask yourself if you are willing to pay more taxes. It takes money and time to go to trial and most times, a plea bargain is the most cost effective solution. Is it the best justice solution? Probably not. BUT can you show me a better Judicial system anywhere else in the world?

I guess I don't understand!! When an officer goes thru their training, isn't MIRANDA RIGHTS beet in to their heads? If not, maybe it should!! How many times in the past year has crimes been dropped or reduced due to them not receiving their MIRANDA RIGHTS? Come on!! This is getting absolutely rediculous!!!!

goes to show you that those two little boys HAS no RIGHTS!! And WHY couldn't the statments given to HHS be used??? HOW CONVIENT!!!FORGET what the OFFICERS saw,waded through and probably SMELLED...just pat the abusers on the back of the hands..say ten hail mary's and tell them to GO AND SIN NO MORE!!! (at least DONT GET CAUGHT)...not that that would matter as they would walk away anyways. totally digusting

This makes me sick! The police saw the children in the kennel, and the conditions they were living in! I understand that some evidence was thrown out, but seriously, a year of probation is a joke!
