The law has apparently caught up with two brothers who use each other’s identities to fool police and the courts. Jathan P.J. Alen Jones, 22, was arrested Friday and charged with failure to appear in court on a charge of minor in possession, third offense. Jathan appeared Monday in Lincoln County Court. He claimed that his brother Jonathan used his identity and should instead face the charge. But Lincoln County Judge Kent Turnbull told Jathan that he and the County Attorney's office are aware that they have used mistaken identities in the past. Deputy County Attorney Jennifer Wellan assured the court that the investigation is complete and Jathan is the correct man to face this charge. Jathan, who is the Lincoln County Jail, appeared very frustrated. He sat down and put his face in his hands, but agreed to accept a public defender. Jathan Jones has a lengthy record, according to Lincoln County Court records. At age 15 in October 2007, he pled guilty to minor in possession. In November 2007 he pled guilty of shoplifting and criminal mischief. In December 2007 he was again charged with and pled guilty to minor in possession. In February 2008 he pled guilty to attempt of a misdemeanor and was charged with minor in possession again in April 2009. Because he failed to appear in court on the last MIP charge, a warrant was issued. He is held on a $5,000 bond.
