Council balks at website agreementTell North Platte what you think
 

The North Platte City Council again tabled discussion about developing a website for the Historic Preservation Commission.

They put the item on the back burner at their last meeting as well. Specifically, the council was not comfortable with awarding the contract to create the site to Art Cottage, Incorporated until some muddy language in the contract was revised.

At the heart of the issue was section 14 of the terms of agreement. It states, “Rights to photos, graphics, source code, work-up files, and computer programs are specifically not transferred to the client, and remain the property of provider.”

Second Ward representative Don Kurre took issue with the idea that Art Cottage would own the rights to any photographs that were posted on the website.

City Planning Administrator Judy Clark stated her belief that the copyright did not extend to photos provided by the city. She also noted that after the matter was tabled at the last meeting the city reserved the right to modify the website in the contract.

“That’s not what it says,” Kurre stated. “This is important stuff. Copyrights are important stuff.”

Judy Pederson, Second Ward, asked Clark if the city had personnel already on staff that could handle the assignment.

Clark answered yes, at the library, but that they had reported they were too busy for the project.

The Third Ward’s Dan McGuire had said that he had been getting mixed signals about whether or not the city could handle the web site construction, and that he would vote against awarding the contract to an outside company.

Jim Parish, Second Ward representative, wondered what server the website would be hosted on.

If the provider hosted the site, Parish said, it could become problematic if the city wanted to change directions or if Art Cottage were to go out of business.

Clark responded that the city would host the site on its servers, and simply contract the construction, and possibly maintenance of the website.

Despite Clark’s assurances, the council voted to table the item 7-1, with Parish against.

So if the city sponsors them, then why does it matter who has legal copyright ownership of images and stuff? If this commission is that butt hurt over it, then they can put a water mark over all their images.

The Historic Preservation Board is city sponsored. Go to the website for the City of North Platte and click on Public Boards. Considering the poor development of the City''s website, I don''t know how anyone could question that an agency or board would want to have a separate website.

I think you all are missing the point of the problem. Who will hold the copyright of the materials posted on the website? Even if you use a free service, you would have to deal with the same issue. And yes, the Historical Commission might go to the community college and get help from a student to design the website. However, what happens when that student moves on to another college or another town? Who is going to maintain the hardware, etc.? There can be a lot of questions to answer and you don''t just take some classes, set up a site and think all is well. One suggestion that I have is for the Historical Commission to contact the Nebraska Library Commission in Lincoln. They operate a website called Nebraska Memories where many different county historical societies, educational institutions and even the Lincoln Police Department have historical photos posted. This might be a temporary solution until a better agreement can be drafted which is acceptable to the City Council.

Is this Historic Preservation Commission a non profit? If they are, they can find places all over the world to host their site either for free or for dirt cheap. And I''m sure they could go to the college and get their web design students to build and maintain the site. Shoot, a few of their employees could take web design classes and do it themselves.

Why not research just how Judy Clark got her job....oh thats right...she just took it upon Jim Perry''s retirement. Then find out who she''s related to. Just another one of Jim Hawks'' overpaid pawns.

One wonders how close a friend or neighbor the Art Cottage people are to Judy Clark. She seems to want this pushed through with a problematic contract. Ummm!
